Advogado Everardo Gueiros se posiciona sobre “saidinhas” de presos

O conceituado advogado Everardo Gueiros não é como qualquer um que deixa de se posicionar sobre fatos do nosso cotidiano para simplesmente não se comprometer com o que pensa A ou B, diante de tal fato conforme pode-se observar em vídeo retirado das redes sociais de Everardo Gueiros podemos observar sua posição diante da aprovação do Projeto de Lei que aprovou na Câmara e Senado a proibição da saída temporária dos presos, que manteve uma exceção para a saída temporária, no caso dos detentos de baixa periculosidade que forem realizar cursos estudantis ou profissionalizantes.


No vídeo, Everardo ressalta que tem vários direitos diferentes a serem tutelados no caso das saidinhas, sendo um o direito do preso de ressocializar-se, porém existe o direito da SOCIEDADE à segurança, à saúde, à vida, ao patrimônio. Everardo deixa no ar para que possamos pensar a seguinte pergunta:

Então, qual direito é maior ?

Seria o direito de o preso de ressocializar ou seria o direito de a sociedade de ter garantida a sua  segurança, já que estão ocorrendo problemas com essas saidinhas ?

Everardo então não deixa de se posicionar garantindo: “EU SOU ABSOLUTAMENTE CONTRÁRIO ÀS SAIDINHAS, EU SOU A FAVOR DO PROJETO DE LEI, SIM.”

Como forma de conselho o nobre advogado ressalta que o Estado deveria encontrar outra forma para ressocializar o preso, que não seja a de colocar em risco a sociedade.

Quanto ao posicionamento da OAB de se posicionar contra o Projeto de Lei já que para a OAB “A saída temporária, como era prevista, era um instrumento de execução da pena privativa de liberdade voltado a fortalecer vínculos familiares, reduzir tensões carcerárias e possibilitar a reintegração social do preso” Everardo Gueiros faz criticas onde segundo ele em momento nenhum se colocaram à disposição para discutir a matéria legislativa e aperfeiçoar a lei, ou seja, ajudar o Congresso Nacional, agora quando os parlamentares estão dando a resposta à sociedade que está exigindo uma resposta, os representantes da OAB aparecem para ficar contrários ao trabalho dos parlamentares.
