Conselho Federal faz representação contra suposto assédio moral do presidente do Conselho Regional da 11ª Região

O Conselho Federal de Fisioterapia e Terapia Ocupacional – COFFITO, protocolou no dia de ontem (28), uma REPRESENTAÇÃO em desfavor de Sérgio Gomes de Andrade, presidente do Conselho Regional de Fisioterapia e Terapia Ocupacional da 11ª Região – Crefito 11, onde segundo a representação se verificou a situação de suposto assédio moral praticado pelo  então presidente em face de empregadas públicas federais.

No teor da representação que segue abaixo há trechos que relatam:

“visivelmente alterado e nervoso e jogou um processo em cima da mesa, assustando a servidora e começou a fazer diversas acusações” (em relação a Sérgio);

“A servidora relatou ainda que após essa reunião. ela saiu da sala e sofreu um ataque de pânico”; onde relata que após o ocorrido iniciou tratamento psicológico, que perdura até a presente data; que fora exonerada do cargo de coordenadora-geral;

Que se abriu processo de sindicância, com a comissão responsável sem isenção alguma;

Que quando voltou de suas férias regulares seus pertences pessoais estavam jogados ao chão, ou seja, segundo a representação fatos feitos à mando de Sérgio;

Que foram interrogadas sem a ampla defesa e o contraditório (basilares de qualquer denúncia);

Que durante os interrogatórios houve indução a mentirem (mesmo uma das servidoras se encontrar em período final de gestação);

Que Sérgio fez menção até mesmo ao filme com o ator norte-americano Ben Affleck que fez um papel de um contador e alegou que todos os contadores eram ladrões, por isso não se confiava neles;

Que solicitou adulteração em um contracheque de uma funcionária  com o intuito de aquisição pela funcionária de um imóvel, citado inclusive testemunhas deste fato; e

Que durante a reforma do Crefito, notas fiscais diferentes que não condiziam com os serviços executados chegavam a todo instante.

A representação remontam os possíveis ataques a dignidade das trabalhadoras com um suposto comportamento discriminatório por parte do atual presidente Sérgio às profissionais que laboram no Crefito-11, onde solicita a instauração de procedimento no âmbito da Procuradoria Regional do Trabalho.

Sonia Mascaro Nascimento na Revista “O assédio moral no ambiente de trabalho” conceitua o assédio moral como “Conduta abusiva, de natureza psicológica, que atenta contra a dignidade psíquica, de forma repetitiva e prolongada e que expõe o trabalhador a situações humilhantes e constrangedoras, capazes de causar ofensa à dignidade ou à integridade psíquica, e que tenha por efeito excluir a posição do empregado no emprego ou deteriorar o ambiente de trabalho, durante a jornada de trabalho no exercício de suas funções”.

Tramita na Câmara de Deputados o Projeto de Lei n.º 1.521/2019 que tipica como crime de assédio moral a conduta de “ofender reiteradamente a dignidade de alguém causando-lhe dano ou sofrimento físico ou mental, no exercício de emprego, cargo ou função”, e comina pena de detenção de um a dois anos e multa, além da pena correspondente à violência.
